Terms of Service

These Terms of Service ("Terms") govern your access to and use of Chateaux (the "Service"), operated by Chateaux Labs as a sole proprietor, doing business as Chateaux ("we", "us", "our"), located at Wilmington, Delaware, USA.

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be 18 or older and legally capable of entering a binding contract. If you are using the Service on behalf of a brokerage, employer, or agency, you represent that you are authorized to bind that organization to these Terms.

2. Your account

  • You are responsible for keeping your login credentials confidential.
  • You are responsible for all activity under your account.
  • You must give us accurate information and keep it current.
  • Notify us immediately at security@chateaux.ai of any unauthorized use.
  • You may not create an account using automated means, misrepresent your identity, or transfer your account to another person without our prior written consent.

3. Subscription plans and billing

3.1 Plans

Pricing tiers and their included features are displayed at chateaux.ai/pricing and inside the app. We may add, remove, or change plan features on 30 days’ notice.

3.2 Trial

A free 14-day trial is offered on new accounts. No credit card is required to start. At the end of the trial, no charge is made unless you explicitly select a paid plan.

3.3 Recurring billing

Paid plans renew automatically at the interval you selected (monthly or annual). By starting a paid subscription, you authorize us and our processor Stripe to charge your payment method each billing period until you cancel.

3.4 Cancellation

You may cancel at any time from Account → Billing. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods except where required by law.

3.5 In-app purchases (mobile stores)

If you subscribe through the Apple App Store or Google Play, billing, refunds, and cancellations are governed by their store terms in addition to these Terms.

3.6 Price changes

We may change prices on 30 days’ notice by email. If you do not agree, you may cancel before the change takes effect.

3.7 Taxes

Prices are exclusive of applicable taxes. You are responsible for any sales, use, VAT, or GST taxes.

4. Your content and license

4.1 Ownership

You retain all rights to content you upload, including listing photos, descriptions, 360° captures, leads, and messages. Your content is your content.

4.2 Limited license to us

You grant us a worldwide, non-exclusive, royalty-free license to store, process, transmit, and display your content solely to provide the Service to you (including generating AI-derived outputs at your request, hosting public listing pages you publish, and sending transactional email).

This license terminates when the underlying content is deleted from your account or 30 days after your account is closed.

4.3 AI-generated output

Output generated by AI features (staged photos, ad copy, seller pitches, panoramas, etc.) is licensed to you for your commercial use in your real-estate practice. You are responsible for reviewing and approving any AI-generated content before publishing it. AI can make mistakes.

4.4 Public content

When you publish a public landing page, public virtual tour, or public business card, that content is intentionally public and accessible without login.

4.5 We do not train models on your data

As stated in the Privacy Policy, we do not use your content — or content of leads you upload — to train AI models, whether ours or third parties’.

5. Acceptable use

Your use of the Service is governed by the Acceptable Use Policy. Highlights (not exhaustive):

  • No fair-housing violations. You may not use Chateaux to discriminate based on race, color, religion, national origin, sex, familial status, disability, or any protected characteristic.
  • No misleading listings. You must accurately represent every property.
  • No impersonation. You may not misrepresent yourself as another agent or brokerage.
  • No scraping of the Service or its output.
  • No re-selling the Service or reverse-engineering the app.
  • Ad platform compliance. When generating Meta or Google ads, you are responsible for complying with each platform’s ad policies (housing category, targeting restrictions, etc.).

Violations may result in suspension or termination.

6. Third-party services

The Service integrates third-party providers (Anthropic, Google, Mapbox, RentCast, Stripe, Resend, Cloudinary). Your use of those integrations is also subject to their respective terms. We are not responsible for the availability, accuracy, or acts of these providers.

7. Beta features

We may label some features as "Beta", "Early Access", or "Experimental". These are provided "AS IS" and may be modified or removed without notice. They may not be as reliable as generally-available features.

8. Intellectual property

All rights, title, and interest in the Service (excluding your content) — including software, designs, trademarks, logos ("Chateaux", the Chateaux monogram), and documentation — belong to Chateaux Labs d/b/a Chateaux. No rights are granted except those expressly stated in these Terms.

9. Feedback

Any feedback you provide (feature requests, suggestions, bug reports) may be used by us without restriction and without compensation. You waive any rights to such feedback except as required by law.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

AI-GENERATED OUTPUTS (STAGING, PANORAMAS, AD COPY, ANALYSIS) MAY CONTAIN ERRORS. CHATEAUX IS NOT A LICENSED APPRAISER, BROKER, OR ATTORNEY. AVMs AND MARKET INTELLIGENCE ARE ESTIMATES, NOT PROFESSIONAL OPINIONS.

WE DO NOT GUARANTEE THAT AI-GENERATED ADS WILL BE APPROVED BY META, GOOGLE, OR ANY AD PLATFORM.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS CAPPED AT THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) US $100.
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION.

Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You will defend, indemnify, and hold harmless Chateaux, its Operator, and its agents from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your content, (c) your violation of these Terms, (d) fair-housing or ad-platform policy violations you commit while using the Service.

13. Suspension and termination

We may suspend or terminate your account at any time for material breach of these Terms, including violations of the Acceptable Use Policy, non-payment, or where required by law. We will notify you when practical.

You may terminate your account at any time via Account → Delete account. See Data Deletion.

14. Modifications to the Terms

We may update these Terms from time to time. Material changes will be announced by email and by an in-app banner at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of Delaware, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, United States, and you consent to personal jurisdiction there.

Class-action waiver. You and Chateaux each waive the right to participate in a class action against the other; disputes must be brought in your individual capacity.

Informal resolution first. Before filing any claim, you agree to contact us at legal@chateaux.ai and give us 30 days to resolve the issue.

16. Miscellaneous

  • Entire agreement. These Terms, the Privacy Policy, and any additional posted policies constitute the entire agreement between you and Chateaux.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce a right is not a waiver.
  • Assignment. You may not assign these Terms without our prior written consent; we may assign in connection with a business transfer.
  • Force majeure. We are not liable for delays or failures caused by events beyond reasonable control.
